Agreement to these terms

By using this website or applying to work with us, you agree to these terms. If you do not agree, please do not use the site.

What we do

Soph Marketing provides lead response, follow-up, appointment booking, and CRM setup services for home service businesses. The scope, fees, and length of any engagement are set out in a separate written agreement or proposal. If that agreement conflicts with these terms, that agreement controls.

Applying to work with us

Submitting the application form does not create a client relationship and does not guarantee that we will work together. We decide which businesses we take on.

Your responsibilities

You agree to give us accurate information, the access we need to the tools and accounts involved, and timely responses. You are responsible for the content you ask us to send on your behalf and for complying with the laws that apply to your business, including rules covering marketing calls and messages.

Messaging compliance

You confirm that the contacts you provide may lawfully be contacted, and that opt-out requests will be honored. We follow carrier and platform requirements and may pause or stop messaging that puts compliance at risk.

Fees and payment

Fees, billing schedule, and any setup charges are set out in your agreement. Unless that agreement says otherwise, fees are non-refundable and invoices are due on receipt.

No guarantee of results

We work hard on outcomes, but we do not guarantee a specific number of leads, appointments, booked jobs, or revenue. Results depend on factors outside our control, including your lead volume, pricing, market, and how your team handles the appointments we book.

Intellectual property

This site and our materials, systems, and templates remain ours. You keep ownership of your brand assets and your customer data.

Confidentiality

Each of us agrees to protect the other party’s non-public business information and to use it only for the engagement.

Termination

Either party may end an engagement as described in the written agreement between us. Terms that by their nature should survive termination will survive.

Disclaimers and limitation of liability

To the fullest extent permitted by law, this site and our services are provided as is, without warranties of any kind. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Neither party is liable for indirect or consequential damages.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules.

Changes to these terms

We may update these terms. Continuing to use the site means you accept the current version.
